Liability Waiver

Pitching is hard on the body, and coaching is done remotely: I see your throwing on video and on calls, not in person. Please read this before subscribing. You agree to it when you subscribe.

“I” means Robert Stock, doing business as Stockyard Baseball. “The athlete” means the pitcher being coached. If the athlete is under 18, their parent or legal guardian agrees to this waiver for themselves and on the athlete's behalf.

The risks

Throwing a baseball, and the training that goes with it, can cause injury. That includes soreness and muscle strains, overuse injuries to the shoulder and elbow (including ligament injuries such as a torn UCL), and injuries from falls, thrown or batted balls, and equipment. Some injuries need surgery or end a playing career. These risks exist even when training is done carefully and correctly.

Because the coaching is remote, the athlete trains on their own, in places and with equipment I don't choose or control, without me there to watch. I can only see what the video shows.

Coaching is instruction, not medical advice

I'm a pitching coach. I'm not a doctor, physical therapist, or athletic trainer, and nothing I say is medical advice or a diagnosis. Coaching doesn't replace a physician or athletic trainer. For pain, an injury, or a question about whether the athlete is healthy enough to train, see a medical professional.

The athlete's responsibilities

  • Be healthy enough to train, and get medical clearance first if there's any doubt.
  • Warm up properly before every throwing session.
  • Stop throwing at the first sign of pain, not just soreness, and get it checked before throwing again.
  • Tell me about any injury, pain, or medical condition that affects training.
  • Train in a safe place, and keep anyone filming or catching out of harm's way.
  • Follow the limits set by the athlete's doctor, team, school, or league on throwing and rest.

It's always the athlete's choice whether and how hard to throw. Any drill or plan I suggest can be adjusted or skipped.

Assumption of risk

Knowing these risks, the athlete takes part voluntarily and accepts the risk of injury that comes with throwing and training, including training that follows my instruction.

Release

To the fullest extent the law allows, you release Robert Stock and Stockyard Baseball from any claim for injury, illness, or loss arising from the athlete's throwing or training in connection with the coaching. This release does not cover gross negligence or intentional misconduct, or anything else the law does not allow to be released.

Athletes under 18

A parent or legal guardian must agree to this waiver for an athlete under 18. By doing so, the parent or guardian confirms they have the authority to agree for the athlete, that they have read and understood it, and that they accept these risks for the athlete and agree to the release on the athlete's behalf and their own. The parent or guardian is responsible for supervising the athlete's training.

How you agree, and for how long

If the athlete is under 18, their parent or guardian agrees to this waiver during the approval process before checkout. The athlete also checks the agreement box before paying. For adults, the agreement box records their consent. The waiver covers all coaching from then on, including any later offseason when you subscribe again.

It's governed by the laws of the State of Missouri. If any part can't be enforced, the rest still applies.
